1. i have known of this being illegal for awhile

2. if i get personally threatened with DDO i first find if person is inside US, if o i lul in his face

3. i have my ISP on speed dial for such occasions of being DDOS cause they have logs of said thing and most DDOS'ers who threaten me dont do a very good job =/

You can just serious jail-time just for controlling a botnet. Using it to DDoS is even worse.

Its so much effort to do that over a video game, you cant just sue people and win money like its the lottery. Its a lengthy, usually expensive process that will span close to a year or more.

It is indeed illegal, but its usually hard to track the person ddosing you considering they most likely have a VPN or use a botnet to do the deed.
